Welcome to Limosa! By using our mobile application and services, you agree to these Terms & Conditions. Please read them carefully. If you do not agree, do not use the app.

Limosa is a mobile application that helps users track and manage bird sightings, connect with other birdwatchers, explore an extensive database of bird species, and share observations with the community.
2. Acceptance of Terms
By accessing or using Limosa, you confirm that you:
- Are at least 13 years old (or 16 in some EU jurisdictions) or have parental permission.
- Have the legal capacity to enter into a binding agreement.
- Will comply with these Terms & Conditions and all applicable laws.
- Accept that we may update these terms from time to time.
If you do not agree with these Terms, you may not use the service.
3. User Accounts
3.1 Account Creation
You must create an account to access Limosa's features. You can sign up using:
- Google Sign-In
- Apple Sign-In
You agree to provide accurate and up-to-date information.
3.2 Account Security
You are responsible for:
- Keeping your account credentials secure
- All activities that occur under your account
- Notifying us immediately of any unauthorized access at security@limosa.online
3.3 Account Suspension/Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms.
- You engage in fraudulent, abusive, or illegal activities.
- You post objectionable content or harass other users.
- We are required to do so by law.
If your account is terminated, you may lose access to all saved data and sightings.
4. Acceptable Use
By using Limosa, you agree not to:
- Post false, misleading, or fraudulent information (including fake sightings or locations).
- Upload copyrighted content without permission.
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene.
- Promote violence, discrimination, hatred, or illegal activities.
- Harass, bully, threaten, or intimidate other users.
- Exploit minors in any way.
- Impersonate other users or misrepresent your identity.
- Use bots, scrapers, or automated tools to access the app.
- Attempt to hack, reverse-engineer, or disrupt our services.
- Circumvent security measures or access restrictions.
- Use the Service for commercial purposes without authorization.
Violation of these rules may result in immediate account suspension, content removal, or legal action.
⚠️ Zero Tolerance Policy
Limosa maintains zero tolerance for objectionable content and abusive users. We reserve the right to remove content and terminate accounts without prior notice for serious violations.
5. User-Generated Content
5.1 Your Content
You retain ownership of content you submit to Limosa (photos, observations, comments, activities). By posting content, you grant Limosa a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service for the following purposes:
- Displaying your sightings and activities to other users
- Generating species distribution maps and statistics
- Improving and promoting the Limosa service
5.2 Content Accuracy
You agree that sightings and observations you submit are accurate to the best of your knowledge. Intentionally submitting false data undermines the integrity of the community and may result in account termination.
5.3 Content Moderation
Limosa employs content moderation to maintain community standards:
- Users can report objectionable content or abusive behavior using in-app reporting features.
- Content found in violation will be reviewed and may be removed.
- Users who repeatedly violate these Terms may be permanently banned.
We are not responsible for user-generated content but reserve the right to remove content that is offensive, illegal, or violates our guidelines.
6. Community & Social Features
Limosa offers community and social features, including:
- Sharing bird sightings and activities
- Following other users
- Liking and commenting on activities
- Blocking users you do not wish to interact with
By using these features, you agree to respect other users and their contributions.
6.1 Reporting Content
If you encounter objectionable content or abusive behavior, please report it immediately using the in-app reporting feature. We review all reports and take appropriate action.
6.2 Blocking Users
You may block any user at any time. Blocked users will not be able to:
- See your profile or content
- Follow you or interact with your activities
- Send you messages or notifications
7. Privacy and Data Protection
- Your personal data is processed in accordance with our Privacy Policy (Read here).
- You have rights over your personal data, including access, correction, deletion, and portability.
- We do not sell your personal data to third parties.
- We use third-party services (Firebase, Mapbox, etc.) as described in our Privacy Policy.

8. Location Data
Limosa uses location data for core functionality:
- Recording the location of your bird sightings
- Displaying sightings on maps
- Showing local species and checklists based on your area
You control your location data through:
- Visibility settings: Public, followers-only, or private sightings
- Location visibility: Show exact location or hide it
- Privacy zones: Automatically hide sightings near sensitive areas
- Device permissions: Grant or revoke location access at any time
We do not track your location in the background.
9. Intellectual Property
9.1 Our Intellectual Property
The Limosa name, logo, branding, software, and original content (excluding user content) are owned by Limosa Software and protected by copyright, trademark, and other intellectual property laws.
9.2 Your Intellectual Property
You retain ownership of your sightings, photos, and uploaded content. The license you grant us (Section 5.1) is limited to operating and improving the Limosa service.
9.3 Restrictions
You may not copy, modify, distribute, sell, or reverse-engineer Limosa's software or content without written permission.
10. Subscriptions and Payments
Limosa may offer premium features through subscriptions:
- Payment Processing: Payments are handled through the Apple App Store and Google Play Store. We do not directly process or store your payment information.
- Subscription Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.
- Cancellation: You can cancel subscriptions through your App Store or Google Play account settings.
- Refunds: Refunds are handled by Apple and Google according to their refund policies. We cannot directly issue refunds for in-app purchases.
- Price Changes: We may change subscription prices with reasonable notice. Existing subscriptions will be honored at the original price until renewal.
11. Service Availability and Updates
- We strive to keep Limosa available 24/7, but we do not guarantee uninterrupted service.
- We may update, modify, or discontinue features at any time.
- Scheduled maintenance will be announced when possible.
- If Limosa is temporarily unavailable, we are not liable for any loss of data or functionality.
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.
Use Limosa at your own risk. We are not responsible for:
- Errors, bugs, or app downtime.
- Loss of data or sightings.
- Incorrect bird identification or misinterpretation of data.
- Content posted by other users.
- Third-party services, websites, or links.
- Your interactions with other users.
Limosa does not provide professional ornithological advice. Species identification and observation data are community-contributed and may contain errors.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Limosa Software shall not be liable for any:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, goodwill, or other intangible losses
- Damages arising from your use or inability to use the Service
- Unauthorized access to or alteration of your data
In jurisdictions that do not allow limitation of liability, our liability is limited to the maximum extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless Limosa Software, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit to the Service
15. Account Deletion
You may delete your account at any time through the app settings. Upon deletion:
- Your personal profile and data will be removed within 30 days.
- Some anonymized data may be retained for analytics purposes.
- Shared community observations may remain visible in anonymized form.
- Account deletion is permanent and cannot be undone.
16. Termination of Service
We reserve the right to modify or discontinue Limosa at any time. If we decide to stop the service permanently:
- We will provide at least 30 days advance notice to users.
- We will provide a means to export your data.
- Active subscriptions will not be renewed.
17. Governing Law & Dispute Resolution
- These Terms & Conditions are governed by the laws of the Netherlands.
- Any disputes shall be resolved in the courts of the Netherlands, unless otherwise required by consumer protection laws in your jurisdiction.
- If you are an EU consumer, you may also use the EU Online Dispute Resolution platform.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
19. Changes to These Terms
We may update these Terms occasionally. If significant changes occur, we will:
- Notify registered users via email or in-app notification.
- Display a notice when you open the app.
- Update the “Last updated” date at the top of this page.
Continuing to use Limosa after updates means you accept the new Terms.
